AND IS GOVERNED BY CANADIAN LAW

NO PURCHASE NECESSARY. 

A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. KEY DATES:

The Great California Raisin Baking Contest (the “Contest”) consists of two (2) competition periods, the recipe competition period (the “Recipe Competition Period”) and the baking competition period (the “Baking Competition Period”), as outlined in the following table:

  1. ELIGIBILITY TO ENTER:

The Contest is open only to residents of Canada who: (i) have reached the legal age of majority in their province/territory of residence at the time of entry, and (ii) are (a) a registered student enrolled in an accredited baking program at the time of entry, or (b) an employee, in good standing, working within the Canadian baking industry at the time of entry in one of the following eligible employment categories: Bakers and Research & Development staff of commercial baking companies; Craft Bakers and Retail Shop Owners/Managers; Certified Baking Teachers; or Bakery Technicians at Bakery Supply Wholesalers, Flour Milling Companies and Other Allied Bakery Ingredient Suppliers. 

Employees (current and retired, and those with whom such persons are living, whether related or not) of the Raisin Administrative Committee (the “Sponsor”), ACI Argyle Communications Inc. (the “Administrator”), their respective distributors, representatives, agents, sponsors, parent companies, subsidiaries, affiliates, prize suppliers, dealers, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”) are not eligible to enter the Contest.  

  1. AGREEMENT TO BE LEGALLY BOUND BY RULES: 

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”).

  1. HOW TO ENTER:

I. Recipe Competition 

NO PURCHASE NECESSARY.  To enter, you must personally prepare one (1) original raisin bread using California Raisins (a “Raisin Bread”) or one (1) original raisin pastry using California Raisins (a “Raisin Pastry”) (each, a “Baking Product”).  Next, go to www.californiaraisins.ca/contest (the “Website”) and follow the on-screen instructions to obtain the Official Contest Entry Form (the “Entry Form”).  Fully complete the Entry Form with all required information during the Recipe Competition Period, including a requirement to: (i) enter your full name, complete mailing address (including postal code), valid email address and telephone number in the space provided; (ii) fully complete the recipe form (the “Recipe Form”) with all required information, as set out below; (iii) agree to receive (or reconfirm your agreement to receive) promotional communications from the Sponsor (Note: entrants can opt-out at any time without impacting their chances of winning in this Contest – for details, please consult the Sponsor’s privacy policy linked below); and (iv) signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Rules.  This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information. Once you have prepared your Baking Product and fully completed the Entry Form (including, without limitation, the Recipe Form) with all required information, follow the on-screen instructions to submit your completed Entry Form (a “Recipe Entry”). 

To complete the Recipe Form, you will be prompted to enter the following required information: (a) how you heard about the contest; (b) current occupation information (including the name of your company and current position, or the name of your school at which you are enrolled in an accredited baking program and the name of the accredited baking program); (c) professional credentials, as applicable (including membership to any baking associations); (d) Baking Product category (either “Best Raisin Bread” or “Best Raisin Pastry”); (e) a brief description of your Baking Product (fifty (50) words or less); (f) name of your Baking Product; (g) finished Baking Product dimensions and shape; (h) amount of raisins in your Baking Product (expressed in grams); (i) Baking Product production time; (j) detailed Baking Product recipe (including amounts and method); and, (k) one (1) exterior photo of your finished Baking Product and one (1) photo depicting a diagonal cut of your finished Baking Product (in .jpeg, or .png format, up to 5 MB per photo). 

FREE PRODUCT REQUEST: To prepare your Baking Product without purchasing California Raisins, send an email: to brian@enitiatives.ca RE: Great California Raisin Baking Contest, attention Brian Berry and include your first name, last name, current occupation information (including the name of your company and current position, or the name of your school at which you are enrolled in an accredited baking program and the name of the accredited baking program), telephone number, and complete mailing address (collectively, a “Product Request”).  Upon receipt of your Product Request in accordance with these Rules (as determined by the Contest Sponsor in its sole and absolute discretion), you will be mailed one (1) 750g pouch of California Raisins to the address provided in your Product Request.  To be eligible, your Product Request must be received during the Recipe Competition Period and your corresponding Recipe Entry (including, without limitation, your completed Entry Form and Recipe Form) must be received by no later than eight (8) business days after the close of the Recipe Competition Period.  Any Recipe Entry received after the close of the Recipe Competition Period submitted by an entrant who did not complete an eligible Product Request will be disqualified. The Sponsor takes no responsibility for any lost, stolen, delayed, damaged, misdirected, late or destroyed Product Requests or corresponding mailed boxes of California Raisins.  Limit of one (1) box of California Raisins per Product Request. The Sponsor will only fulfill eligible Product Requests for the purposes of facilitating an eligible entrant’s participation in the Contest. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) for the purposes of verifying an entrant’s eligibility to participate in this Contest prior to fulfilling a Product Request. 

II. Baking Competition 

After the close of the Recipe Competition Period, six (6) Finalists (three (3) Finalists from among all eligible Raisin Bread Recipe Entries received and three (3) Finalists from among all eligible Raisin Pastry Recipe Entries received) will be selected by the Contest Judges in accordance with the procedures described below.  Each confirmed Finalist will be eligible to compete in the “Great California Raisin Baking Contest”, held at the Toronto Congress Centre in Etobicoke, Ontario at The Bakery Showcase Trade Show & Conference during the Baking Competition Period.  For greater certainty and the avoidance of any doubt, only the six (6) confirmed Finalists, as determined by the Contest Judges in their sole and absolute discretion, may participate in the Contest during Baking Competition Period.  The Great California Raisin Baking Contest will consist of confirmed Finalists preparing and presenting their selected Raisin Bread or Raisin Pastry Recipe Entry (as applicable) to the Contest Judges, which must be completed during the Baking Competition Period and in accordance with all requirements communicated by the Sponsor or its representatives (a “Baking Entry”). 

To be eligible, your Recipe Entry or Baking Entry (each, an “Entry” and collectively, “Entries”) must be received in accordance with these Rules during the Recipe Competition Period or Baking Competition Period, as applicable. 

  1. ENTRY LIMIT AND CONDITIONS:

There is NO limit to the number of Recipe Entries that can be submitted.  For greater certainty and the avoidance of any doubt, entrants can submit multiple Recipe Entries for each Baking Product category, regardless of the method of entry.  One (1) Recipe Entry may be submitted per original Baking Product; duplicate Baking Product submissions are not eligible.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii), use multiple names, multiple identities, multiple e-mail addresses, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the Contest; and/or (iii) disrupt or participate in the Contest in any other fraudulent or misleading way, then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  The Contest Parties and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).  An Entry may be rejected if, in the sole and absolute discretion of the Sponsor, the Entry is not completed in accordance with these Rules.

  1. VERIFICATION:

All Entries, Baking Products, Entry Forms, Recipe Forms, Product Requests and entrants are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry, Baking Product, Entry Form, Recipe Form, Product Request and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of the Contest will be the official time-keeping device(s) used by the Sponsor.

  1. PARTICIPATION REQUIREMENTS:

BY PARTICIPATING IN THIS CONTEST, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST.  BY PARTICIPATING IN THIS CONTEST, YOU ALSO AGREE THAT YOUR ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF) AND ALL OTHER ASPECTS OF YOUR PARTICIPATION IN THIS CONTEST COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A FINALIST OR THE GRAND PRIZE WINNER, A PRIZE (INCLUDING ANY USE OR MISUSE OF A PRIZE).  THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE.

By participating in the Contest, each entrant hereby warrants and represents: (i) that any Entry he/she submits does not contain any reference to any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence; (ii) he/she personally prepared his/her Baking Product(s); and (iii) any Entry he/she submits will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party. 

By entering the Contest and submitting an Entry, each entrant: (i), grants to the Sponsor, in perpetuity, a worldwide, non-exclusive, worldwide license to publish, display, reproduce, modify, edit, make available, communicate to the public by telecommunication and otherwise use all content and materials associated with his/her Entry, in whole or in part, for advertising or promoting the Contest or for any other reason in any type of media; (ii) waives all moral rights in and to his/her Entry (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry); and (iii) agrees to release and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.   

  1. PRIZES:

I. Recipe Competition Prizes

There are six (6) prizes available to be won by the Recipe Competition Finalists (three (3) prizes available for the Raisin Bread Finalists and three (3) prizes available for the Raisin Pastry Finalists), as set out below (each, a “Finalist Prize”).  Each Finalist Prize consists of a trip for one (1) to Etobicoke, Ontario to compete at the Great California Raisin Baking Contest during the Baking Competition Period, including: (i) round-trip economy airfare for one (1) person to Etobicoke, Ontario from the major Canadian airport nearest to the winner’s residence (as determined by the Sponsor in its sole and absolute discretion); (ii) three (3) nights hotel accommodation (one room, single occupancy in a hotel to be selected by the Sponsor in its sole and absolute discretion); and (iii) $200 CAD for local transportation to/from the Toronto Congress Centre in Etobicoke, Ontario and/or meals during the Baking Competition.  The total approximate retail value of each Finalist Prize is $1,400 CAD based on a Vancouver, British Columbia hypothetical departure point example. IMPORTANT NOTE: In the event that a confirmed winner resides within a 240 km radius of Etobicoke, Ontario (as determined by Sponsor in its sole and absolute discretion), the applicable Finalist Prize will not include airline travel and no alternative prizing will be provided.  

II. Baking Competition Grand Prize

There are two (2) grand prizes available to be won by the Baking Competition Grand Prize winners (one (1) grand prize available for the Raisin Bread Grand Prize winner and one (1) grand prize available for the Raisin Pastry Grand Prize winner), as set out below (each, a “Grand Prize”).  Each Grand Prize consists of a trip for one (1) to California, U.S.A., including: (i) round-trip economy airfare for one (1) person to a destination in California, U.S.A. (as determined by the Sponsor in its sole and absolute discretion) from the major Canadian airport nearest to the winner’s residence (determined by the Sponsor in its sole and absolute discretion); (ii) six (6) nights hotel accommodation (one room, single occupancy in a hotel to be selected by the Sponsor in its sole and absolute discretion); (iii) two (2) day Raisin Baking Study Tour at the Culinary Institute of America; (iv) visit to local bakeries and tour to see how California raisins are harvested and processed; and (v) three (3) meals a day for the confirmed winner, once in California, USA.  In addition, the winning recipe of each confirmed Grand Prize winner will be featured online on RAC’s website and social media channels and each confirmed Grand Prize winner will be announced on BAC’s website, e-newsletters and printed newsletter. The total approximate retail value of each Grand Prize is $4,000 CAD based on a Halifax, Nova Scotia hypothetical departure point example. 

Without limiting the generality of the foregoing, the following terms and conditions apply to each Finalist Prize and Grand Prize (each a “Prize” and collectively, the “Prizes”): (i) the Prize must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions except at Sponsor’s option; (iii) all travel related to a Finalist Prize must occur between April 23, 2020 and April 30, 2020, and all travel related to a Grand Prize must occur between September 1, 2020 and November 30, 2020 on the dates determined by the Sponsor in its sole and absolute discretion (otherwise the applicable Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (iv) the confirmed winner must have all necessary documentation to permit travel; and must not have any legal barrier to travel to, and return from, the Prize destination; (v) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed winner, including, without limitation: transportation for the confirmed winner to and from the Canadian departure airport; excess baggage and other fees; and items of a personal nature (NOTE: the confirmed winner may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses); (vi) if the confirmed winner does not utilize any part(s) of the Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (viii) all travel arrangements relating to the Prize must be made through the Sponsor or its designated agents; (ix) by accepting the Prize, the confirmed winner agrees to waive all recourse against the Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) neither Sponsor nor any of its prize suppliers will replace any lost or stolen tickets; (xi) any difference between the actual value of the Prize and its stated approximate retail value will not be awarded; (xii) all characteristics and features of the Prize (and of each Prize element), except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (xiii) precise travel arrangements are subject to space and flight availability and shall be made at the Sponsor’s sole and absolute discretion; (xiv) once booked, travel arrangements may not be changed by the Prize winner; (xv) certain blackout dates and further restrictions may apply; (xvi) the Released Parties will be in no way responsible in the event that any part of the Prize is delayed, cancelled, postponed or rescheduled for any reason whatsoever; (xvii) Sponsor is not responsible in the event a confirmed winner is unable to travel for any reason, in which case, the Prize will be forfeited and nothing will be provided in its place; and (xviii) the Sponsor reserves the right to change any of the dates and/or Prize description at its sole and absolute discretion.

  1. ELIGIBLE WINNER SELECTION PROCESS:

I. Recipe Competition 

After the end of the Recipe Competition Period, a panel of judges (the “Recipe Competition Contest Judges”) appointed by the Sponsor at its sole and absolute discretion will judge and assign a score (each, a “Recipe Score”) to each Raisin Bread and each Raisin Pastry Recipe Entry on the basis of the following weighted criteria (the “Recipe Competition Judging Criteria”):

Each entrant whose Raisin Bread Recipe Entry obtains one (1) of the top three (3) Recipe Scores from among all Raisin Bread Recipe Entries received, and each entrant whose Raisin Pastry Recipe Entry obtains one (1) of the top three (3) Recipe Scores from among all Raisin Pastry Recipe Entries received will be selected as a Recipe Competition Period finalist (each, a “Finalist”) and will be eligible to win a Finalist Prize to compete at the Great California Raisin Baking Contest during the Baking Competition Period.  For certainty, six (6) Finalists will be selected in total (three (3) Raisin Bread and three (3) Raisin Pastry Finalists). To be eligible to win a Finalist Prize, a Finalist must be able to attend and compete at the Great California Raisin Baking Contest during the Baking Competition Period and able to attend the Grand Prize trip (as outlined above) should he/she be selected as a Grand Prize winner. The odds of being selected as a Finalist depend on the number and calibre (based on the Recipe Competition Judging Criteria) of eligible Raisin Bread or Raisin Pastry Recipe Entries (as applicable) received during the Recipe Competition Period. 

In the event of a tie between two or more Raisin Bread or two or more Raisin Pasty Recipe Entries based on Recipe Score, the entrant associated with the Recipe Entry – from amongst all such applicable Recipe Entries that are tied – with the highest score on the Use of Raisins criterion listed above (followed in the event of a further tie by Creativity/ Uniqueness, then Marketability) will be deemed to have obtained the higher Recipe Score.  In the event of an exact tie based on Use of Raisins, Creativity/ Uniqueness and Marketability, the Sponsor will perform a random draw from amongst all such applicable Recipe Entries that are tied to determine the Recipe Entry deemed to have obtained the higher Recipe Score.  Judging is scheduled to be completed in Toronto, Ontario on or about February 27, 2020 (the “Finalist Selection Date”).

II. Baking Competition

After the end of the Baking Competition Period, a panel of judges (the “Baking Competition Contest Judges”) appointed by the Sponsor at its sole and absolute discretion will judge and assign a score (each, a “Baking Score”) to each Raisin Bread and each Raisin Pastry Baking Entry on the basis of the following weighted criteria (the “Baking Competition Judging Criteria”):

The Finalist whose Raisin Bread Baking Entry obtains the top Baking Score from among all Raisin Bread Baking Entries, and the Finalist whose Raisin Pastry Baking Entry obtains the top Baking Score from among all Raisin Pastry Baking Entries will each be eligible to win a Grand Prize.  For certainty, two (2) Grand Prize winners will be selected in total (one (1) Raisin Bread and one (1) Raisin Pastry Grand Prize winner). The odds of winning a Grand Prize depend on the number and calibre (based on the Baking Competition Judging Criteria) of eligible Raisin Bread or Raisin Pastry Baking Entries (as applicable) received during the Baking Competition Period. 

In the event of a tie between two or more Raisin Bread or two or more Raisin Pastry Baking Entries based on Baking Score, the entrant associated with the Baking Entry – from amongst all such applicable Baking Entries that are tied – with the highest score on the Use of Raisins criterion listed above (followed in the event of a further tie by Taste, then Presentation/ Appearance) will be deemed to have obtained the higher Baking Score.  In the event of an exact tie based on Use of Raisins, Taste and Presentation/ Appearance, the Sponsor will perform a random draw from amon gst all such applicable Baking Entries that are tied to determine the Baking Entry deemed to have obtained the higher Baking Score.  Judging is scheduled to be completed in Etobicoke, Ontario on or about April 27, 2020 (the “Grand Prize Winner Selection Date”).

  1. ELIGIBLE WINNER NOTIFICATION PROCESS:

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact each potential Prize winner by phone or email within five (5) business days of the Finalist Selection Date and Grand Prize Winner Selection Date, as applicable.   If a potential winner cannot be contacted within five (5) business days, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select the next highest scoring entrant as a potential Prize winner from among the remaining applicable eligible Entries submitted and received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).  

  1. ELIGIBLE WINNER CONFIRMATION PROCESS:

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE RULES.  BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each potential winner will be required to sign and return within seven (7) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof, including any travel related thereto; (iv) agrees to indemnify the Released Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry or any portion(s) thereof; and (v) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet, worldwide and in perpetuity.  

  1. GENERAL CONDITIONS:

All Entries (including without limitation, Recipe Entries) become the property of the Sponsor.  This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.  ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.  

The Released Parties will not be liable for: (i) any failure of any website or platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website, including the online Entry Form; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above.

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Québec, to cancel, withdraw, amend or suspend the Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  Any attempt to undermine the legitimate operation of the Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, subject only to the approval of the Régie in Québec, to cancel, amend or suspend the Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

The Sponsor reserves the right, subject only to the approval of the Régie in Québec, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by Sponsor, for purposes of verifying compliance by any entrant, Entry and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

FOR RESIDENTS OF QUÉBEC ONLY: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://calraisins.org/legal/privacy-policy/).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the French version of these Rules, the Sponsor’s Page, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.  The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to the Contest.
